CAPCOM MEMBERSHIP REWARDS PROGRAM
TERMS AND CONDITIONS

In order to register for the Capcom Membership Rewards Program (the “Membership Rewards Program”) and to access and use the Membership Rewards Program on the Capcom Store website (the “Store”), you must agree to the Capcom Membership Rewards Program Terms and Conditions (the “Terms and Conditions”) set forth herein.
The Membership Rewards Program is a loyalty program integrated in the Capcom Store (since February 7, 2019) that gives back to our loyal customers for shopping and participating in activities planned throughout the year and in the future.
No purchase is necessary to join the Membership Rewards Program. Nevertheless, Members-to-be must be eligible to create an Account in accordance with the Terms of Sale. All Members must be 18 years of age and older. If Members are between at least 13 and 18 years of age, the Members must have parental or legal guardian consent. The Membership Rewards Program is limited to individual membership only and to one membership account per individual.
The Membership Rewards Program is void where prohibited or restricted by law.
By creating an Account on the Store, an Account holder accepts, or the parent or legal guardian of a participating minor accepts, to be bound to these Terms and Conditions.
In order to enrol in the Membership Rewards Program (a “Member”), you must create an Account on the Store and agree to all applicable terms and conditions and policies set forth therein.
Membership will be identified by their Account identifier. In order to receive Capcom Points for Qualifying Actions (as defined below) or to inquire about Account balance, Members may be requested to show suitable identification in order to assist with verification of Account ownership and to assist with the protection and safeguarding of personal information.
ELIGIBILITY TO REWARDS
The Membership Rewards Program digital and physical goods content and rewards are available to all Members residing in the territories to which the Store ships products. To properly credit your Account with the Capcom Points or Membership Badges (as defined below), you must be logged in your Account before performing any Qualifying Action (as defined below).
REWARDS / EARNING POINTS
Members can earn points (the “Capcom Points”) by making qualifying actions (the “Qualifying Actions”) on the Store such as purchases or any other actions Capcom determine as eligible. Capcom Points will not be earned for any monetary redemption, gratuities, or delivery charges paid or for purchases of any Capcom products outside the offered rewards on the Store. Capcom in its sole discretion may also award, through the Reseller, Capcom Points and other rewards for specific Members’ statuses or special events. Each Qualifying Action on the Store is attributed a number of Capcom Points at the sole discretion of Capcom.
Capcom Points will be credited to your Account at the time of the validation of the corresponding Qualifying Action. For purchases, the amount of Capcom Points earned will be displayed on the Members receipt for the transaction. The Capcom Points will be credited through the Reseller to the Members account only when the transaction is confirmed and validated by Capcom. Transactions are considered validated when the payment of the total amount is received by the Reseller. For pre-orders, Capcom Points will be credited only when the total amount due for the pre-ordered Product is received by the Reseller.
Members are solely responsible for notifying Capcom of any actual or perceived discrepancies or omissions with regard to the Capcom Points earned. Adjustments will be made in Capcom‘s sole discretion.
Capcom reserves the right to determine the amount of Capcom Points in any Membership Account based on Capcom’s internal records related to such Membership Account. The Capcom Points balance, displayed in Capcom’s internal records, shall be deemed to be the correct balance. In the event of an inconsistency between the amount of Capcom Points accrued in a Membership Account or receipt and Capcom’s internal records, Capcom’s internal records will control.
BONUS CAPCOM POINTS
Capcom may run bonus Capcom Points promotions (the "Bonus Points Promotions") under which Members will be able to earn additional or bonus Capcom Points (the "Bonus Points") in connection with certain Qualifying Actions or in connection with other specially designated, limited time promotions such as specially designated bonus reward shopping days (the "Bonus Reward Days"). During and in connection with such Bonus Point Promotions and Bonus Reward Days, Members will earn bonus points on each Qualifying Action only as specified in the corresponding offer. Bonus Point Promotions and Bonus Reward Days are subject to the terms and conditions of the corresponding offer and may be offered at any time in Capcom's sole discretion.
Members may access their Capcom Points balance through their Account, on the Store, or by contacting Customer Service (as defined in the Terms of Sale).
Capcom may award, through the Reseller, Membership badges (the “Membership Badges”), defined and arbitrarily modifiable by Capcom. Membership Badges may unlock levels of rewards accessible to Members and will not be counted toward Capcom Points.
Capcom Points may not be redeemed for any monetary value or for any Capcom product sold on or off the Store. The Membership Rewards Program’s rewards are not for sale and non-transferable. Neither Capcom nor the Reseller does not recognize and cannot be held responsible for any prize listed outside the Store.
Capcom Points accumulated on different Accounts of different Members MAY NOT be combined or aggregated.
Capcom Points may be redeemed only on a dedicated catalogue of prizes and rewards on a special section of the Store or as otherwise expressly authorized by Capcom (“Capcom Rewards”). Members may be required to pay shipping fees and applicable taxes for Capcom Rewards.
REAL MONEY TRADING
Real Money Trading (“RMT”) is the sale of Capcom Points, Membership Badges, Accounts, or any virtual property to obtain real money. RMT activity is strictly prohibited. Capcom may, in Capcom’s sole discretion, permanently terminate the Account of any Member who Capcom suspects or believes participated (directly or indirectly) in RMT.
Capcom Points will expire one year after the last Qualifying Action made to acquire a Capcom Point.
Capcom Points will also expire in the following cases:
- Immediately, upon termination of the associated Account, or
- Immediately upon the termination or suspension of the Membership Rewards Program, or
SWEEPSTAKES, CONTESTS AND OTHER QUALIFYING EVENTS
These Terms and Conditions will apply to the participation in the Store’s qualifying sweepstakes, contests, or other promotions (the “Qualifying Events”). These Qualifying Events may have rules or specific terms and conditions, which Members are required to read and accept. By Participating in these Qualifying Events, Members agree and accept to be bound to those specific terms and conditions.
NON-TRANSFERABILITY OF POINTS, DEDUCTIONS DUE TO CANCELLATION
Orders, Capcom Points, Membership Badges, and Capcom Rewards are not transferable from one Account to another. If a Member experiences difficulty accessing a previous Account or wishes to modify personal information, he/she may contact our Customer Service.
In the event a Qualifying Action is cancelled (such as an order cancelation) or reversed, Capcom reserves the exclusive right to deduct the Capcom Points and Membership Badges awarded for the Qualifying Action. For the sake of clarity, order cancelation includes returned, refused, or refunded orders, orders that result in credit card chargebacks, as well as orders considered fraudulent.
Negative Capcom Points balance may occur after such deductions.
RESELLING CAPCOM REWARDS
SUSPENSION / TERMINATION OF MEMBERSHIP AND CAPCOM POINTS
Capcom reserves the right in its sole discretion to suspend or revoke a Membership Account on the Store (including suspending the Members ability to earn rewards with his/her Capcom Points and/or other rewards earned in connection with his/her membership in the Membership Rewards Program) in the event of any violation of these Terms and Conditions (including the prohibition on reselling Capcom Rewards), any violation of the Terms of Sale, any violation of any other Reseller or Capcom policies or terms, any suspected misconduct, any fraud or abuse, and any actual or suspected illegal conduct. Further, if Capcom concludes in its sole discretion that a Member has engaged in any of the foregoing or that his/her Account has been compromised, Capcom may also (i) terminate the Members’ ability to earn Capcom Points and Membership Badges, (ii) terminate the Members’ ability to exchange Capcom Points for Capcom Rewards and/or receive other rewards earned in connection with his/her membership, (iii) temporarily or permanently remove some or all Capcom Points and/or Membership Badges from the Account, or (iv) take any other appropriate action.
The interpretation and application of these Terms and Conditions are at Capcom’s sole discretion and determination.
SUSPENSION / TERMINATION / MODIFICATION OF THE MEMBERSHIP REWARDS PROGRAM AND POLICIES
Capcom reserves the right, in its sole discretion and at any time, to terminate or suspend the Membership Rewards Program. If Capcom terminates the Membership Rewards Program, Members will no longer earn Capcom Points, Membership Badges, or other rewards. Any Capcom Points or other rewards will expire as stated on the Store and in these Terms and Conditions. Members will not receive any compensation in the event of modification, termination, or suspension of the Capcom Membership Rewards Program.
All aspects of the Store, the Account, and the Membership Reward Program (including but not limited to Capcom Points and Membership Badges) are owned by Capcom. You do not have any property rights in the Account, the Membership Rewards Program, Capcom Points, Membership Badges, any virtual items, etc. You acquire no ownership or property rights in such accounts or items, and are only licensed to use such accounts or items subject to the conditions set forth in these Terms and Conditions, the Terms of Sale, and any other applicable Reseller or Capcom terms or policies. You agree that your Account and the Membership Rewards program (including but not limited to Capcom Points and Membership Badges) do not have any monetary value. Capcom may suspend, terminate, modify, or delete Accounts, the Membership Rewards Program, Capcom Points, Membership Badges, Account names, virtual goods, or the service altogether, at any time for any reason or for no reason, with or without notice to you and without any liability to you.
LIMITATION OF LIABILITY AND DISCLAIMER
MEMBERS SHALL USE THE MEMBERSHIP REWARDS PROGRAM AT THEIR OWN RISK. NEITHER CAPCOM (INCLUDING ITS CURRENT AND FUTURE AFFILIATES) NOR ITS RESELLER, SCALEFAST INC. IS LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, AND/OR ANY OTHER DAMAGES OR LOSSES THAT MAY RESULT FROM ACCESSING THIS STORE OR USING ANY INFORMATION, SERVICES, OR MERCHANDISE PROVIDED. THE STORE, MEMBERSHIP REWARDS PROGRAM, AND ANY INFORMATION ARE PROVIDED ON AN “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS” BASIS, WITHOUT ANY EXPRESS OR IMPLIED WARRANTY OF ANY KIND UNLESS SPECIFICLY PROVIDED BY CAPCOM. Neither Capcom, its current and future affiliates, nor the Reseller is responsible for interrupted or unavailable network server or other connections, miscommunications, computer transmissions or jumbled, scrambled or misdirected transmissions, or for electrical, network, computer hardware, or software or program malfunctions, failures, or difficulties, or for other errors, omissions, interruptions, or deletions of any kind whether human, mechanical, or electronic or for any damage to any person’s computer, data, or property related to participating in the Membership Rewards Program. Capcom is not liable for the compensation of any Capcom Points or any other reward in the case of any error occurring in their account and purchases.
MEMBER HEREBY RELEASES AND AGREES TO INDEMNIFY AND HOLD HARMLESS Capcom, its current and future affiliates, its Reseller Scalefast Inc., and each of their shareholders, officers, directors, employees, contractors, agents, and representatives from and against any and all costs, claims, damages, or any other injury, whether due to negligence or otherwise, to person(s) or property (including, without limitation, death or violation of any intellectual property or personal rights, such as violation of right of publicity/privacy, libel, or slander), due in whole or in part, directly or indirectly, to the Members participation in the Membership Rewards Program, or the receipt, use or misuse, of Capcom Points or any other reward.
To the extent any provision of these Terms and Conditions is found to be invalid or unenforceable by a court or competent tribunal with jurisdiction, such provision shall be severed to the extent necessary for the remainder to be valid and enforceable.
